Mountain Adventure Travels Singapore Indemnity Form – Personal Responsibility and Safety Are Priorities

TRAVEL PARTICIPATION AGREEMENT AND RISK ACKNOWLEDGMENT

1. Parties

This agreement is between:

1. Mountain Adventure Travels (“Organiser”), and
2. The undersigned participant (“Participant”).

2. Description of Activities

The Participant will take part in a group travel programme organised by the Organiser, which may include transport, outdoor activities, and excursions (“Activities”).

3. Acknowledgment of Risks

The Participant understands that the Activities involve inherent risks, including:

1. Travel accidents, falls, illness or injury,
2. Weather conditions and terrain,
3. Equipment failure,
4. Actions of other participants or third parties.

The Participant accepts these inherent risks as part of participating in the Activities.

4. Participant Responsibilities

The Participant agrees to:

1. Take reasonable care for their own safety,
2. Follow all reasonable instructions given by the organiser or guides,
3. Act responsibly and not endanger others,
4. Comply with all local laws and regulations.

5. Organiser Responsibilities

The Organiser agrees to:

1. Exercise reasonable care and skill in organising and conducting the Activities,
2. Provide services consistent with what a reasonable organiser would provide in similar circumstances.

6. Travel Insurance

The Participant confirms that they:

1. Have purchased comprehensive travel insurance, and
2. Understand they are responsible for ensuring the policy is adequate for the activities (including medical evacuation and emergency assistance).

7. Medical and Emergency Costs

The Participant is responsible for their own medical, evacuation, rescue, and related costs.

8.1 Limitation of Liability

Nothing in this agreement excludes or limits liability:

1. For death or personal injury caused by negligence, or
2. For any liability which cannot be excluded under singapore law.

8.2 Other Losses

Subject to clause 8.1 and to the extent permitted by law, the Organiser is not liable for:

1. Loss of or damage to personal property,
   1. Indirect or consequential loss (e.g. Loss of enjoyment, loss of opportunity).

8.3 Liability cap

To the extent permitted by law, any liability of the Organiser for direct loss or damage (other than non-excludable liability under clause 8.1) shall be limited to:

1. The total amount paid by the Participant for the trip, or
2. Any higher amount covered by the Organiser’s insurance (if applicable).

9. Indemnity

The Participant agrees to indemnify the Organiser only to the extent that losses arise from:

1. The Participant’s breach of this agreement,
2. The Participant’s negligence or reckless conduct,
3. The Participant’s wilful misconduct.

This indemnity does not apply where the loss is caused by the Organiser’s negligence or breach of duty and does not exclude liability that cannot be excluded under Singapore law.

10. Assumption of Risk

The Participant accepts responsibility for:

1. Risks arising from the inherent nature of the Activities, and
2. Their own acts or omissions.

11. Changes, Delays, and External Factors

The Participant acknowledges that travel plans may be affected by factors outside the Organiser’s control (e.g. weather, government restrictions, transport disruptions).

The Organiser will make reasonable efforts to manage such situations but is not responsible for unavoidable disruptions, subject to clause 8.

12. Fitness to Participate

The Participant confirms they are:

1. Physically and medically fit for the Activities,
   and/or
2. Have taken independent medical advice where necessary.

13. Governing Law

This agreement is governed by the laws of Singapore.

14. Entire Agreement

This document forms the entire agreement relating to participation in the Activities.

15. Participants Under 18

If the Participant is under 18 years of age, a parent or legal guardian must sign this agreement on their behalf.

16. Acknowledgment

The Participant confirms that they:

1. Have read and understood this agreement,
2. Understand the risks involved,
3. Agree to the terms voluntarily.
